General state practise – maritime countries that have navies and have conflicts on sea - we have to look at these countries and see what practice has been over the time. – that’s what we looking about general state practice.
Opinio iuris – you can find it through court decisions. You can also find it through treaties. Opinio iuris. – others cases or treaties.
France vs Turkey [after WWI]. There both sides ship in the sea. France ship smashed into Turkish ship in international waters.
Under the positivism Turkish law would apply unless Turkey gave up its sovereignty/ its rights through treaty or through customs.
In this case France found two cases where this was illegal for country to prosecute sailors for accident on seas or international waters. And turkey found – two cases where this was lawful. There was no custom because it was 2 on 2. If that is custom in international community? –no. there is no customary law in this case.
US v NICARAGUA
Example of treaty as resource of custom. 1980 – country was ruled by dictator and there was a revolution. They replaced him with communist regime. USA was not happy about that and tried to overthrown that government/regime. Nicaragua filed a case against USA and went to ICJ saying that USA violating international law.
Is UN Charter a treaty? – yes.
If you have a treaty that signed by all countries of the world it could also be used as an evidence of custom. [general state practice +opinio iuris]
