Sources of law

• The fundamental sources of law in the WTO is, therefore, the text of the Marrakesh Agreement Establishing the World Trade Organization.
The other law or rules of international law binding upon States regardless of specific ratification in fact this means that any law mentioned in the Article 38 (1) of the statute of the International Court of Justice or brought into WTO dispute settlement by Article 3.2 and 7 of the DSU is an Applicable Law in this case.

In practice, Article 3.2 has led panels and Appellate Body to Articles 31 and 32 of the Vienna Convention on the Law of Treaties, which have been held to codify customary international law.
