Asylum law is significantly connected with the policy of immigration, although it is a distinct and separate system of rules designed to meet the needs of persons who have been persecuted due to the reasons of race, religion, nationality, political opinion or membership to a social group, this leading them to flee their country of origin in search of asylum in foreign countries.
The Treaty of Amsterdam provided the process of harmonization with a new impact. In it, the asylum matters had been transferred from the Third pillar to the first one. The treaty empowered the Council to adopt a group of binding documents on asylum law in the EU countries thus allowing for a common European asylum system. This purpose has been further elaborated on in the following European Councils in Tampere and Laeken.
Three years after the treaty of Amsterdam had entered into force only several documents have been adopted, among them the directive on temporary protection. The Commission has, however, already tabled the major proposals concerning the asylum to the Council.
Although the proposals may possibly be changed, the author argues, in reference to the analysis presented in the master’s thesis, that the current tendencies of harmonization are mere attempts to codify the existing practice of states concerning the asylum while paying due regard to the international obligations of the Member States under the human rights treaties.
However, having in mind that the requirement of a unanimous decision in order to adopt the measures in question, it would be unreasonable to expect more. The current proposals and the process of harmonization also allow concluding that the Union is heading towards a common asylum system.
