Just War Tradition and the Strategic Bombing of Dresden

Before entering into main discussion on various principles, rules and doctrines, it is important to mention that there are some pacifist scholars claiming that the whole idea of just war tradition is wrong from the beginning and that war can never be just nor justified. Non-violence pacifists claim that killing itself violates the principles of human life as having an infinite value, it violates the people’s right to live and it contradicts the principle of justice: killer wants to kill others, but does not want to be killed himself.1 There are also non-war pacifist approach claiming that the use of force can sometimes be justified, but only if it leads towards the disarmament and peace2.
The realist approach (together with positive and natural law) claims, however, that war in certain circumstances is inevitable and that the attempts have to be made to limit its damage by following the just war tradition.3 Just war tradition has its origins in the Christian tradition that was incorporated in the war doctrines of the ancient Rome. The conduct of war was initiated and later formed by early thinkers such as Cicero, Augustine of Hippo, Thomas Aquinas, Vitoria, Grotius and others.4 Modern just war tradition consists of two major parts: jus ad bellum (legal causes of going to war) and jus in bello (actions legally permitted in war).
The second rule of jus in bellum is proportionality.15 It originates from the notion that punishment should fit the crime. It is, however, difficult to measure the harm. It is a matter of argument whether the harm should be counted in civil casualties, economic or moral damage or something else. Once the war is started, parties often fight till the victory (or surrender) they do not stop because the harm is remunerated.
