Redundancy.
• Redundancy is when you dismiss an employee because you no longer need anyone to do their job. This might be because your business is: changing what it does. doing things in a different way, for example using new machinery.
• The term ‘layoff’ has the same meaning as redundancy in both British and American English. In South Africa it is called ‘retrenchment’. Layoff used to mean only the temporary suspension of employment, but today includes both the temporary and permanent states. Most people these days add the word ‘temporary’ before ‘layoff’ if the situation is not permanent.
Contract of employment
• It is usual practice for employers and employees to enter into a written agreement which sets out their respective obligations and rights, and which constitutes a contract of employment, either at the commencement of employment or shortly before. Clauses in the contract generally deal with pay, deductions, hours of work, time off and leave, place of work, absence, confidentiality, restrictions on the actions of an employee once employment is ended, giving notice, the grievance procedures in the event of job loss, and variation of contract.
• Employers are bound by the employment contract and statutory regulation as to how they may deal with employees, particularly in relation to the termination of employment.
CONTRACT TYPES.
The most common type of employment contract in Lithuania is open-ended employment contract . However, there are various other types of employment contracts:
• fixed-term employment contract which duration for the same function may not exceed 2 years with several exceptions (the maximum duration is 5 years);
• temporary agency employment contract is concluded between employee and temporary work agency;
• apprenticeship employment contract is a fixed-term contract, which is concluded when a person is employed for the...
