Combatting non-piracy violence on the high seas: legal options and limits
INTRODUCTION
As in any field of law, in Law of the Sea, there are certain rules, specifications, and regulating measures to ensure an efficient and bullet-proof system, that ensures safety and protection for all individuals. And as in every other category, it is also common for illegal activities and crimes to occur, in the instance of the high seas, the situation is even direr, because of the specifics of the location, not belonging to any specific jurisdiction, therefore it is crucial to understand the legal procedure and background, to ensure the interests of all states.
Therefore, it is critical to understand and distinguish specific acts of violence occurring on the high seas, regimes, legal documents, and procedures enshrined in them to assess the accountability regarding them. In this work, we will try to establish the main definitions of non-piracy violence acts and what the key elements of distinguishing them are. Also, what zone is considered as the high seas, and what are the legal documents implementing rules on the above-mentioned situations while using real-life examples of such instances occurring. Moreover, this can only be accomplished while dissecting definitions and broadening the rules, which are already established in the legal regime of the Law of The Sea, which we will try to achieve.
This paper’s topic was selected, due to a lack of proper analysis of other maritime crimes, apart from piracy violence acts. Therefore, there is a great need to further examine the worsening state of violent acts occurring in the scope of the high seas.
NON-PIRACY VIOLENCE ON THE HIGH SEAS – DEFINITION
WHAT IS NON-PIRACY VIOLENCE?
To begin with, in international maritime law, maritime security is considered the primary responsibility of the International Maritime Organization (hereinafter – IMO), where secure international travel of vessels is the foundation of free movement at sea. In the scope of maritime security, specifically talking about non-piracy violence, IMO’s Convention for the Suppression of Unlawful Acts against Safe Maritime Navigation (hereinafter – SUA Act) is one of the most important legal documents. In its preamble, there is an expressed aim established, that seeks to defend the main principles and goals of maritime safety and security, while highlighting the need for it because of an increase of terrorist and violent acts increasingly occurring all over the world.
